Anyone can go to their local gun store and buy a tactical vest. The Police or SWAT patches are just held on by velcro, and I'm pretty sure they're department-issued or ordered through some LEO vendor. Quite different than a uniform.
As far as other gear, my rifle has a military issue BUIS, which nearly anyone can buy as well. Many of my magazines are stamped LEO, but more importantly, a bunch of them have the SWAT trainer's name written on them with a Sharpie. When I asked about that, he said those guys will steal just about anything.

He was joking of course, but I found it funny that even the most elite of our local officers have to keep an eye on their gear.
Just because something is illegal in your jurisdiction, doesn't mean it is illegal in mine. For instance, anyone who can legally own a gun, has $9k (plus another $200 for your tax stamp) can be doing this in Utah:
